The Sentencing Principles of Equality and Proportionality from a Feminist Perspective: Exploring Positive Gender Discrimination at Sentencing

Feminism revolutionized criminology. Important issues were questioned within the feminist agenda, such as (in)equality in criminal justice system and disproportionate impact of imprisonment on women. In a scenario worldwide increasing female incarceration, gender-differentiated sentencing regimes have been discussed, aiming at reducing prison sentences. present study, we set out to answer following question: from criminological perspective, is it possible reconcile idea differentiated regime for women fundamental rights equality proportionality sentencing? Building upon analytical categories domination patriarchy (Gerda Lerner, Catharine MacKinnon, Sylvia Walby), our goal break logic gender neutrality/insensitivity sentencing. Equality cannot be only relevant considerations On contrary, positive discrimination requirement substantive justice. The study explores some possibilities, introducing mitigating circumstance due womanhood, or when woman offender does not pose significant risk society she primary caregiver dependents, especially children. Such discussion necessarily involves empirical data countries like Brazil, where growth has particularly alarming, are often violated system. More importantly, suggest defining new purpose sentencing: emancipation empowerment. As result, sentences should seriously treated ultima ratio, applicable exceptional cases (violent sexual crimes).
